Contract Notice Addendum

Addendum
Date of Addendum: 22/06/2022
Reason for Addendum: Pursuant to Instruction to Participants ITP 9.1, the Client hereby amends the Tender Document as follows:

In Contract Agreement (file “ECEPP Works Single 3.3 Contract Forms.docx”), point 2. is replaced as follows:
“2. The following documents, in order of precedence, shall be deemed to form and be read and construed as part of this Agreement. This Agreement shall prevail over all other Contract documents.
(a) the Letter of Acceptance
(b) the Letter of Tender
(c) the Addenda No’s . . . . . [insert addenda numbers if any]
(d) the Appendix to Tender
(e) the Particular Conditions
(f) the General Conditions
(g) the Specification
(h) the priced Bill of Quantities, completed by the Contractor and submitted as part of its Tender
(i) the Drawings; and,
(j) the Schedules and any other documents forming part of the Contract.”


In Particular Conditions (file “ECEPP Works Single 3.2 Particular Conditions of Contract (PCC) Dec 21_01.docx”), the following Sub-Clause is added:

Sub-Clause 1.5 Priority of Documents

Second paragraph of Sub-Clause 1.5 is replaced as follows:

(a) “Contract Agreement
(b) the Letter of Acceptance
(c) the Letter of Tender
(d) the Appendix to Tender
(e) the Particular Conditions
(f) these General Conditions
(g) the Specification
(h) the priced Bill of Quantities, completed by the Contractor and submitted as part of its Tender
(i) the Drawings; and,
(j) the Schedules and any other documents forming part of the Contract.”
